H.R. 2117: Health Freedom Protection Act

As some are already aware and others are starting to explore (vitamins toxins?) that there is a movement in Europe (CODEX) and the US to limit availability of supplements (some foods are considered supplements, it doesn’t have to be in pill forms or other “medicine-type” form) to a doctor’s prescription. Also the FDA continues to expand their fingers into complementary/alternative options possibly without adequate information (see article on warnings sent to bioavailable hormone companies FDA cracks down on custom-made hormones).

There is a bill in the US House of Representatives that was introduced in May 2007 that proposes to expand food nutrition labeling and information about supplements called the H.R. 2117: Health Freedom Protection Act. If you would like to know how to take action and/or would like a commentary on the bill by Citizens for Health, email me and I will forward to you the email I received. Please put in the Subject of the email “HR Bill” and it would be appreciated if you also included your name (if different than in your email) that you use in here.

    GlaxoSmithKline Petition to FDA a Threat to Supplements

    Washington, DC - On April 17th, 2008, pharmaceutical giant GlaxoSmithKline (GSK) submitted a Citizen Petition calling on the U.S. Food and Drug Administration (FDA) to reclassify all weight loss support claims for dietary supplements as disease claims.

    GSK was joined in this petition by three organizations that it generously supports: the American Dietetic Association, The Obesity Society and Shaping America?s Health. The organizations? signatories included a lobbyist, a person who helped get obesity classified as a disease and a fundraising guru.

    If the FDA were to agree with this petition, American consumers would be unarguably cheated out of hundreds of legally and responsibly marketed dietary supplement products. The stage would be set for challenges to other types of claims and for what could develop into irreparable damage to the dietary supplement industry and irrevocable losses to consumer choice.

    So the questions are these:

    1. Are we willing to see irreparable harm come to health food supplements?

    2. Do we want Big Pharma to manipulate the tools of public redress to do this?

    3. Do we want to offer the drug makers with an incalculable revenue boon while delivering a mortal wound to the natural products industry?

    4. Do we want Big Pharma and the FDA to decide what sorts of products we can have access to?

    5. Or do we want to keep our dearly won health freedoms?

    If your answer is ?No!? to the first four questions and ?Yes!? to the very last question,

    then you need to send your letter to the FDA today!

    At least some of the petitions listed on the Democracy In Action link provided by Raw Orleans appear to be outdated.

    The only references I found to the first item, Give Health a FAIR Chance Lobby Week, were from 2005 (a letter from Organic Consumers Association). The OCA site has a link to sign and send a letter to Obama in support of organic food and farming (http://salsa.democracyinaction.org/o/642/petition.jsp?petition_KEY=1737).

    The second issue, HR 3156 (Dietary Supplement Access and Awareness Act) is a dead issue according to www.govtrack.us. It was Introduced June 30, 2005 (in the 109th congress) and Referred to Committee. No further action was taken. Because it was introduced in a previous session of congress no further action can be taken on this bill. I don't mean to imply that the issue itself is dead. But this specific bill has been cleared from the books.

    Incidentally, the 110th congress does have an active bill by the same number -- HR 3156 - Violent Crime Control Act.

    Please don't misinterpret my intentions here. I am strongly in favor of communicating with elected officials, particularly on these kinds of issues. I just want to be sure I am supporting active bills and issues.
